The seven-member court which was led by Lt. Gen Andrew Gutti at the General Court Martial in Makindye ruled that Kitatta and nine of his co-suspects had a case to answer and were to explain how they acquired the guns, bullets and the military uniforms that were found in their possession.

The court ruled that having addressed its mind on the law and evidence of the four prosecution witnesses, it was satisfied that prosecution had made out a case against Kitatta and he was found in possession of a golden pistol in a hotel room at Vine for which he should start defending himself on the next year on January 7, 2019
